1. Acceptance of Terms

By accessing or using FinCommand at fincommand.net ("the Service"), creating an account, or clicking "Create Account," you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms, do not use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

These Terms constitute a legally binding agreement between you and FinCommand ("we," "us," "our"), operated as a sole proprietorship in Canada.

2. Description of Service

Beta Service

FinCommand is currently in beta. During the beta period, the Service is provided free of charge or at reduced pricing. Beta users acknowledge that the Service may contain bugs, incomplete features, or unexpected behaviour. We appreciate your patience and feedback during this period.

3. Accounts & Eligibility

Eligibility

You must be at least 18 years of age to create an account and use the Service. By creating an account, you represent that you are 18 or older. If you are between 13 and 17, you may only use the Service with the explicit consent and supervision of a parent or legal guardian.

Account Creation

You may create an account using an email address and password, or by signing in with your Google account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

Each person may maintain only one active account. Creating multiple accounts to circumvent subscription limits or access restrictions is prohibited.

4. Subscriptions & Billing

Beta Period

During the current beta period, FinCommand is available free of charge to beta users. We reserve the right to introduce paid subscriptions in the future. Beta users will receive at least 30 days' advance notice before any free features become paid.

We may offer a permanent free tier with limited features. The features included in the free tier are at our sole discretion and may change over time with reasonable notice.

Important: FinCommand is a financial organization and analysis tool. It is not a registered financial advisor, investment advisor, broker-dealer, tax advisor, or legal advisor. Nothing in the Service constitutes financial, investment, tax, or legal advice.

7. Your Data

Ownership

You own all financial data you enter into FinCommand. We do not claim any ownership rights over your personal financial information.

License to Operate

By using the Service, you grant FinCommand a limited, non-exclusive license to store, process, and display your data solely for the purpose of providing the Service to you. This license does not include the right to use your data for advertising, sale to third parties, or any purpose beyond operating the Service.

Data Accuracy

You are responsible for the accuracy of data you enter. FinCommand is not responsible for decisions made based on inaccurate data you have provided.

Backups

While we provide cloud sync functionality, you are responsible for maintaining your own backups of important financial data. We recommend regularly using the Export All Data feature. We are not liable for data loss resulting from technical failures, account termination, or other causes.

8. Intellectual Property

The Service, including its design, code, features, branding, and content (excluding your personal financial data), is owned by FinCommand and protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or create derivative works from any part of the Service without our express written permission.

The FinCommand name, logo, and brand identity are proprietary to FinCommand. You may not use them without prior written consent.

9. Third-Party Services

FinCommand integrates with third-party services including Supabase, Cloudflare, Financial Modeling Prep, Anthropic, and Google. Your use of these services through FinCommand is subject to their respective terms of service and privacy policies.

We are not responsible for the availability, accuracy, or conduct of third-party services. If a third-party service is unavailable, certain FinCommand features may not function.

Links to third-party websites within the Service are provided for convenience only. We do not endorse and are not responsible for the content of third-party websites.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FINCOMMAND SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

Effect of Termination

These Terms are governed by and construed in accordance with the laws of the Province of Alberta, Canada, and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in Alberta, Canada, in accordance with the Arbitration Act (Alberta), except that either party may seek injunctive relief in a court of competent jurisdiction.

You agree that any claim must be brought within one year of the event giving rise to the claim.
